A Sampling of Gregory Barchie's Cases:

  • During pretrial proceedings in two unrelated lawsuits, Barchie and Gerald Sauer obtained the exclusion of the opinions to be proffered at trial by the opposing party’s damages experts that gutted the other side’s case and resulted in the entry of judgment in favor of S&W’s clients.
  • With Robert S. Chapman, obtained $2.5 million arbitration award in favor of our celebrity client against his product licensee, including holding the corporation’s owner personally liable under an alter-ego theory.
  • Successfully defended a guarantor on a multi-million-dollar loan sued for breach of guaranty based on the “sham guaranty” doctrine; compelled plaintiff-lender to dismiss and walk away from outstanding principal on the loan in the amount of $12 Million.
  • Prevailed on several Anti-SLAPP Motions pursuant to Code of Civil Procedure § 425.16, including against claims for breach of contract/lease in an environmental contamination case and fraud and intentional interference with economic advantage in a dispute between a borrower and her mortgage loan brokers.

  • With Gerald Sauer, obtained a substantial settlement on behalf of a well-known film production company after the company was cut out of a prior settlement arising from a failed video game project involving an iconic American singer-songwriter.

A Sampling of Gregory Barchie's Cases:

  • With Robert S. Chapman, prevailed in a breach of lease action for client, a landlord, against a major supermarket chain that resulted in recovery in excess of $1.8 Million.
  • Prevailed in a real estate/breach of lease matter for client involving responsibility for payment of ADA improvements and obtained an award of 100% of the client’s attorney’s fees.
  • Successfully negotiated a favorable settlement on behalf of client, a yoga studio, in a dispute against a landlord related to the termination of the lease.
  • Successfully negotiated a dismissal/walk-away settlement for a restaurant client that was sued for ADA violations.
  • After multiple mediations, Gregory and Gerald Sauer obtained a substantial settlement on behalf of client who purchased oceanside residence in Malibu that flooded on the same day the transaction closed.

A Sampling of Gregory Barchie's Cases:

  • Prevailed on motion for partial summary judgment on liability for client involved in copyright and rights of publicity dispute; thereafter, at trial as to damages obtained favorable verdict including attorney’s fees under Civil Code § 3344.

  • Negotiated a favorable settlement on behalf of a pharmaceutical company in a dispute against a former employee and his new employer arising from the former employee’s misuse of proprietary and confidential information.

A Sampling of Gregory Barchie's Cases:

  • Authored the brief and argued before the California Court of Appeal in obtaining affirmance of a trial court order in favor of a client that sustained a demurrer without leave to amend.
  • Co-wrote a brief in a case before the California Court of Appeal concerning the interpretation of the anti-SLAPP statute and whether a direct action for contractual indemnity “arises from” activity protected by the First Amendment.
